1. Acceptance of Terms
By accessing or using Portals Foresight (the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.
2. Service Description
Portals Foresight provides an EVM transaction simulation API, related dashboard tools, documentation, and associated developer services. The Service enables users to preview token transfers, swaps, and multi-step DeFi operations across 30+ supported EVM-compatible networks. Access may be provided through API keys, wallet-based payment flows, or other methods we make available from time to time.
3. Eligibility and Accounts
- You must provide accurate information when creating an account and keep your account information reasonably up to date.
- You are responsible for safeguarding your credentials, API keys, wallet access, and all activity occurring under your account or credentials.
- You may use the Service only if you have the authority and legal right to enter into these Terms and to submit the data you send to the Service.
- We may refuse registration, suspend access, or reclaim usernames, key names, or account identifiers where reasonably necessary for security, abuse prevention, or legal compliance.
4. Your Data and License to Operate the Service
- As between you and Portals, you retain your rights in the inputs, requests, and other data you submit to the Service.
- You grant us a non-exclusive, worldwide, limited license to host, copy, cache, transmit, process, analyze, and otherwise use your submitted data as needed to provide, secure, monitor, improve, support, and enforce the Service and these Terms.
- You represent that you have all rights and permissions needed to submit your data to the Service and to allow us to process it under these Terms.
- We may use aggregated or de-identified data derived from Service usage for analytics, benchmarking, operations, product development, and other lawful business purposes.
5. API Access and Usage
- API access is subject to rate limits, monthly quotas, concurrency limits, and plan restrictions that may change over time.
- API keys are confidential. You must not share, publish, or expose them in client-side code, public repositories, or insecure environments.
- We may rotate, suspend, throttle, or revoke API access if we reasonably believe doing so is necessary to protect the Service, enforce plan limits, prevent abuse, or comply with law.
- You are responsible for reviewing outputs before relying on them in production, on-chain execution, trading, treasury, or other operational workflows.
6. Billing, Subscriptions, and Payments
- A free tier may be available with limited usage. Paid plans, if offered, are generally billed in advance on a recurring basis through Stripe or another payment provider we designate.
- Subscriptions renew automatically until canceled. Plan changes may take effect immediately or at the next billing cycle, depending on the change and the billing flow.
- If wallet-based or x402-style payment flows are offered, you are responsible for approving the payment, any applicable network fees, and the accuracy of the destination wallet or network used.
- Fees are exclusive of taxes unless stated otherwise. You are responsible for applicable taxes, duties, levies, or similar governmental charges.
- We may change pricing, packaging, quotas, or feature availability prospectively. Refunds, credits, and exceptions are granted at our discretion unless required by law.
- We may suspend or limit paid access for failed payments, chargebacks, suspected fraud, or material billing disputes.
7. Acceptable Use
You may not, and may not encourage or assist others to:
- Use the Service for illegal, fraudulent, deceptive, or unauthorized purposes.
- Attempt to bypass or interfere with authentication, quotas, rate limits, security controls, or payment mechanisms.
- Reverse-engineer, decompile, disassemble, tamper with, or attempt to derive source code from non-open components of the Service, except to the extent prohibited by applicable law.
- Resell, sublicense, lease, or provide the Service to third parties as a standalone product without our written permission.
- Submit malicious transaction data, exploit attempts, automated abuse, denial-of-service traffic, or other inputs intended to disrupt the Service or third-party infrastructure.
- Use the Service in a way that infringes intellectual property, privacy, publicity, or other rights of others, or that violates sanctions, export controls, or other applicable regulations.
8. Third-Party Services and Networks
The Service depends on third-party infrastructure, including authentication providers, payment processors, email providers, RPC providers, blockchain data providers, contract metadata services, and blockchain networks themselves. We do not control those third-party systems and are not responsible for outages, errors, delays, censorship, forks, chain reorganizations, mempool conditions, bridge failures, oracle changes, or other third-party behavior that affects the Service or your results.
9. Simulation-Specific Disclosures
- Simulation outputs are estimates based on the chain state and infrastructure available at the time of the request.
- Actual on-chain outcomes may differ because of mempool activity, state changes, price movement, oracle updates, sequencing, reorgs, liquidity changes, chain congestion, or protocol-specific behavior.
- The Service is a developer tool, not financial, investment, legal, tax, or fiduciary advice.
10. Intellectual Property
- The Service, including our software, branding, site content, documentation, and related materials, is owned by Portals or its licensors and is protected by applicable intellectual property laws.
- Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your internal business or personal purposes.
- If you provide feedback, suggestions, or ideas about the Service, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use them without restriction or compensation.
11. Suspension and Termination
We may suspend, limit, or terminate your access to the Service at any time if we reasonably believe you have violated these Terms, created security or legal risk, failed to pay fees when due, or used the Service in a way that could harm Portals, our users, vendors, or third parties. You may stop using the Service at any time. Sections that by their nature should survive termination will survive, including payment obligations, disclaimers, liability limitations, indemnity obligations, and intellectual property provisions.
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." PORTALS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR ACCURATE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PORTALS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, DIGITAL ASSETS, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$100.
14. Indemnity
You agree to defend, indemnify, and hold harmless Portals, its affiliates, and their respective officers, directors, employees, contractors, and agents from and against claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service, your submitted data, your violation of these Terms, or your violation of applicable law or the rights of any third party.
15. Changes to the Service and Terms
We may change, suspend, or discontinue all or any part of the Service at any time. We may also update these Terms from time to time. If we make material changes, we may provide additional notice where appropriate. Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the revised Terms.
